End User License Agreement (EULA)

This End User License Agreement ("Agreement") is a legal agreement between you ("User") and Jonathan Allen Feucht, sole proprietor of Dataescher ("Licensor"), regarding your use of the Dataescher HexEditor software ("HexEditor") and the included command-line tool "DHex" (together, the "Software"). By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this Agreement.

License Grant

Licensor grants User a non-exclusive, non-transferable license to install and use the Software under the following terms:

• Single-User License: Each purchased license permits activation of the Software on one computer.
• Activation: Upon activation, User is entitled to free upgrades for up to one (1) year from the date of activation.
• Perpetual Use: Versions of the Software released within the one-year upgrade period may be used perpetually on the activated computers.
• New Licenses: Versions released more than one year after activation require a new license for continued use on the same computer.
• Company Licenses: If a license is required for multiple users or company-wide usage, a separate agreement must be negotiated.

Ownership

The Software and all associated intellectual property rights remain the exclusive property of Licensor and CheckSum, LLC. CheckSum, LLC is entitled to unlimited usage of the Software and licenses free of charge indefinitely.

Restrictions

User agrees not to:

• Reverse-engineer, decompile, or disassemble the Software, including both HexEditor and DHex.
• Redistribute, sell, sublicense, or otherwise transfer the Software without prior written permission from Licensor.
• Use the Software in a manner that violates applicable laws or infringes upon the rights of any third party.

Code Signing Certificate

The Software is signed with a code-signing certificate. Users may use this certificate to validate the authenticity of the Software.

Limitation of Liability

Licensor is not liable for:

• Any damages resulting from User modifications to critical files using the Software.
• Bugs or errors in the Software leading to data loss.
• Incompatibility with specific hardware or software configurations.
• Claims of patent infringement by third parties.

In no event shall Licensor's total liability exceed the amount paid for the license.

Termination

This Agreement is effective until terminated. Licensor may terminate this Agreement if User fails to comply with its terms. Upon termination, User must uninstall and destroy all copies of the Software.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law principles.

Miscellaneous

This Agreement constitutes the entire agreement between User and Licensor regarding the Software.

Any modifications to this Agreement must be made in writing and signed by both parties.

By using the Software, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement.
