End User License Agreement (EULA)

This End User License Agreement ("Agreement") is a legal agreement between you ("User") and Jonathan Allen Feucht, sole proprietor of Dataescher ("Licensor"), regarding your use of the DHex command-line application ("DHex" or the "Software"). By downloading, installing, copying, or otherwise using the Software, you agree to be bound by the terms of this Agreement.

Grant of Use

DHex is provided free of charge and may be used by any User for personal, educational, commercial, or enterprise purposes without payment of license fees.

This Agreement does not grant the User any ownership interest in the Software. All rights not expressly granted are reserved by the Licensor.

Ownership

The Software and all associated intellectual property rights are owned exclusively by Dataescher and CheckSum, LLC. CheckSum, LLC is entitled to unlimited internal usage of the Software free of charge indefinitely.

Restrictions

User agrees not to:

• Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code or internal algorithms of the Software.
• Modify, adapt, translate, or create derivative works of the Software without prior written permission from the Licensor.
• Redistribute the Software in modified form or represent it as the work of any party other than the Licensor.
• Use the Software in a manner that violates applicable laws or infringes upon the rights of any third party.

Code Signing Certificate

The Software is signed with a code-signing certificate. Users may use this certificate to verify the authenticity and integrity of the Software.

Limitation of Liability

To the maximum extent permitted by law, Licensor shall not be liable for:

• Any damages resulting from the use or misuse of the Software.
• Loss of data, corruption of files, or system damage arising from use of the Software.
• Bugs, errors, or inaccuracies in the Software.
• Incompatibility with specific hardware, operating systems, or software configurations.
• Claims of patent infringement or intellectual property violations by third parties.

In no event shall Licensor be liable for any indirect, incidental, consequential, or special damages, even if advised of the possibility of such damages.

Termination

This Agreement is effective until terminated. Licensor may terminate this Agreement if User fails to comply with its terms. Upon termination, User must cease all use of the Software and destroy all copies in their possession.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law principles.

Miscellaneous

This Agreement constitutes the entire agreement between User and Licensor regarding the Software and supersedes all prior or contemporaneous agreements or understandings.

Any modifications to this Agreement must be made in writing and signed by both parties.

By using the Software, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement.
