End User License Agreement (EULA)

This End User License Agreement ("Agreement") is a legal agreement between you ("User") and Jonathan Allen Feucht, sole proprietor of Dataescher ("Licensor"), regarding your use of the DHex command-line tool ("Software"). By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this Agreement.

1. License Grant

Licensor grants User a non-exclusive, perpetual, royalty-free license to install, use, and distribute the Software for any purpose, including commercial use, subject to the following conditions:

• The Software is provided free of charge.
• No activation, registration, or license key is required.
• Users may install the Software on unlimited computers.
• Users may redistribute the Software, provided this Agreement accompanies any distribution.

2. Ownership

The Software and all associated intellectual property rights remain the exclusive property of Licensor. Pursuant to a separate agreement, CheckSum LLC holds an irrevocable, transferable, worldwide, nonexclusive, royalty-free license to use the Software. This license granted to User does not transfer ownership of the Software to User.

3. Restrictions

User agrees not to:

• Reverse-engineer, decompile, or disassemble the Software.
• Remove or alter any copyright notices, trademarks, or other proprietary notices.
• Misrepresent the origin of the Software or claim authorship.
• Use the Software in a manner that violates applicable laws or infringes upon the rights of any third party.

4. No Warranty

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.

5. Limitation of Liability

Licensor is not liable for:

• Any damages resulting from User modifications to files using the Software.
• Bugs or errors in the Software leading to data loss.
• Incompatibility with specific hardware or software configurations.
• Any indirect, incidental, special, or consequential damages.

IN NO EVENT SHALL LICENSOR'S TOTAL LIABILITY EXCEED ZERO DOLLARS ($0), AS THE SOFTWARE IS PROVIDED FREE OF CHARGE.

6. Termination

This Agreement is effective until terminated. Licensor may terminate this Agreement if User fails to comply with its terms. Upon termination, User must uninstall and destroy all copies of the Software.

7. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law principles.

8. Entire Agreement

This Agreement constitutes the entire agreement between User and Licensor regarding the Software. Any modifications to this Agreement must be made in writing and signed by both parties.

By using the Software, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement.
